The use of the WhatsApp application for receiving services from ALYN Hospital is subject solely to the patient's consent and discretion. Accordingly, the patient bears full and exclusive responsibility for the use of this service and any consequences arising from such use.
It is acknowledged that using the WhatsApp application entails inherent risks associated with communication networks, including systems and software upon which the application is based. These risks include, but are not limited to, malware (such as viruses and Trojan horses), wiretapping, unauthorized access by hostile entities, identity theft, and various forms of online fraud. There is also a risk of unauthorized access to or breach of data repositories and/or disruption of systems, including disruption of the application’s operation and/or information contained therein, as well as information provided by you. ALYN Hospital exercises no control over the operation of the WhatsApp application. Therefore, all responsibility for using this service and its outcomes lies exclusively with the patient.
Accordingly, and for the purpose of safeguarding your privacy, it is recommended that the use of the device, and particularly the WhatsApp application, be restricted solely to your personal use. (As the transmission and/or exposure of sensitive and private content concerning you may occur, at your discretion, through this service.) It is further recommended to enable additional protective measures on your device, including the use of a device passcode and/or biometric identification.
Use of the application is subject to WhatsApp’s Terms of Service. By joining this service, you agree to those terms. ALYN Hospital does not control, operate, or supervise the WhatsApp application. Consequently, ALYN Hospital does not guarantee and shall not be held liable for the performance and/or results arising from the use of the WhatsApp application and/or reliance upon it. ALYN Hospital further does not guarantee that the application will operate continuously or error-free or that the information presented through the application will be accurate or free from faults. For the avoidance of doubt, ALYN Hospital neither recommends nor advises the use of the WhatsApp application.
It should be emphasized that certain actions performed through this service may be stored on WhatsApp servers using end-to-end encryption, in accordance with WhatsApp’s privacy policy. However, backups of conversations may also be stored on your behalf without such encryption. Therefore, this matter also remains solely your responsibility. Any use of the application, including the provision of information containing personal or sensitive data, shall be at your sole and exclusive responsibility. The fact that ALYN Hospital allows you to receive services via the WhatsApp application does not imply that ALYN Hospital endorses the application’s legality, reliability, or any other related aspect.
It is further emphasized that any information transmitted about you via WhatsApp, whether by you or by ALYN Hospital upon your request to use this service, may include personal and sensitive information and may be retained by WhatsApp or its affiliates, including in cloud storage. By using the service, you consent to the sharing and transfer of such information—including personal and sensitive data—via the WhatsApp application to WhatsApp and/or its affiliates. You also consent to the storage, transfer, and sharing of this information by WhatsApp and/or its affiliates.
ALYN Hospital does not provide absolute protection of its information systems, communication networks, or the application against breaches, unauthorized access, or prohibited use of the data provided by you during the use of WhatsApp. Accordingly, ALYN Hospital shall not be held liable in the event of any exposure, disclosure, or misuse of the aforementioned data, or any malfunction related thereto, and shall not be liable for any direct or indirect damage resulting from the use of the WhatsApp application. Any use made by you of the application and/or by ALYN Hospital on your behalf shall be at your sole responsibility.
Moreover, ALYN Hospital shall not be liable for any damage and/or defect and/or malfunction and/or loss of any kind, including (without limitation) damage to hardware and/or software and/or data loss that may occur to you, directly or indirectly, as a result of using the WhatsApp application. ALYN Hospital shall also not be liable for any damage, harm, or loss arising from reliance on information presented through the application, or due to malfunction or defect in the software operating the application or access to it, or due to termination or suspension of services provided through WhatsApp.
It is hereby clarified that your acceptance of these Terms of Use by using the application constitutes your full and informed consent that you shall have no claim and/or demand and/or legal action against ALYN Hospital regarding your choice to receive services through the WhatsApp application.
The service provided to ALYN Hospital patients through WhatsApp is subject to the sole discretion of ALYN Hospital, and the hospital may terminate this service at any time for any reason. ALYN Hospital also reserves the right to modify these Terms of Use at any time.
For the avoidance of doubt, the term "patient" refers to both genders and includes any legal representative of the patient—such as parents, guardians, or other authorized individuals—who are legally entitled to act on the patient's behalf in this context.
